Ford ocultó un defecto en ciertos vehículos Ford Fiestas y Ford Focus que puede causar sacudidas, dificultades para detenerse e incluso fallos del motor, según alega una nueva demanda colectiva.

Los demandantes Margaret Barnes, Eric Senkyrik, Michael Hogan y Sharon Jackson presentaron la demanda colectiva contra Ford Motor Company el 17 de junio en un tribunal federal de Delaware, alegando violaciones de la ley federal y estatal de consumidores. 

Buscan representar a cualquier persona en Estados Unidos que haya comprado o alquilado cualquier vehículo Ford Fiesta 2017-2019 y Ford Focus 2017-2018 equipado con transmisiones de doble embrague DPS6.

Según la demanda colectiva, Ford diseñó y comercializó su "transmisión PowerShift" como una alternativa más avanzada y de menor consumo que una transmisión manual o automática tradicional, también conocida como transmisión manual automatizada. 

En teoría, una transmisión manual automatizada debería tener la comodidad de una transmisión automática sin sacrificar la eficiencia de combustible y la velocidad de cambio de un vehículo de cambio manual, afirma la demanda colectiva de Ford. 

"En la práctica, sin embargo, la transmisión PowerShift de Ford está plagada de numerosos problemas y preocupaciones de seguridad", dice la demanda.

Los demandantes afirman que las transmisiones PowerShift de los vehículos presentan un defecto que provoca deslizamientos de la transmisión, sacudidas, sacudidas, enganches bruscos, desgaste interno prematuro, aceleraciones bruscas, retraso en las reducciones de marcha, aceleración retardada y dificultad para detenerse.

Dicen que el defecto acaba provocando un "fallo catastrófico de la transmisión".

Según la demanda, el problema se debe a los defectos del sistema de embragues "secos" de la transmisión, que hacen que los embragues se sobrecalienten y fallen, además de dañar otros componentes de la transmisión.  

Los demandantes dicen que Ford nunca ha reconocido públicamente que el supuesto defecto de la transmisión PowerShift existe. 

"Por el contrario, Ford ocultó activamente, y sigue ocultando, el defecto de la transmisión, entre otras cosas, diciendo a los clientes que los síntomas asociados con el defecto de la transmisión eran 'condiciones normales de conducción'", afirma la demanda colectiva de Ford.

Los demandantes alegan que Ford reconoce internamente que no hay una solución permanente para el supuesto defecto; sin embargo, continuó fabricando y distribuyendo vehículos de la clase con el defecto de transmisión PowerShift hasta el año modelo 2019.

Los demandantes solicitan la certificación de la acción colectiva, daños y perjuicios, honorarios, costes, intereses y un juicio con jurado. 

Mientras tanto, en 2020, Ford resolvió una demanda colectiva en la que se alega que la transmisión PowerShift de Ford, instalada en determinados años de modelo de los vehículos Ford Focus y Fiesta, era defectuosa de manera que ponía en peligro a los pasajeros y a otros automovilistas.

My daughter has a 2012 Ford Fiesta, it has been at the shop 8 weeks and so far we are in about $4300. They replaced the dual clutch and now the TCM needs replaced which we are being told is out 10 months to over a year. She os a 21 year old still paying on this car as it was bought several months ago (ran great, well serviced and low miles) before all this happened. This is so crappy on Ford’s part to know their transmissions are junk but still continued to make them, not to mention, knew of the problems but only ship out the bare minimum number of parts to help the consumers. Sickening!! Ford just lost some customers that is for sure!

We are the same in uk with a kuga though they dont believe us its so scary to drive it we have now reached the point our engine blew up. And they are still mucking us about.

I have a 2012 Focus SE and transmission is giving me the typical stuttering and non shifting this transmission has a history of. How do I join the class action law suit?

Purchased a 2012 Ford Fiesta in late 2021. about 6 months later with less than 90K miles had to have transmission repaired at a cost of about 5k. Good for not even 2 week and got code. Took in to dealer once again and the said it needs a new TCM which there is not ETA on when the part will be available. Service advisor said they tried several after market TCMs but they did not work and he suggested that I source my own. Still no ETA on when part will be available. Ford needs to take responsibility for this faulty system.

When I purchased this vehicle I noticed jerking and slow acceleration.i had purchased it used and looked into warranty policy to find out it had expired before I could get the work done after a trip to Chicago love vehicle completely went out on me on the highway almost severe crash now I took it to the shop $2,600 later still having a problem now with the TCM and now it’s had a Ford waiting on a part of the which they have no idea when that will be would definitely want to be a part of any lawsuits please give me information on how to go about.

I bought a 2013 Ford Focus in November 2017 with only 11,500 miles. In 2019 the clutches was replaced because the car would not speed up and seal leaking. We contacted Ford and fixed it but the problem still continues . We had to take it back 3 times in 10 months. In May 2022 now the seal begins to leak again , when I took it back they say it is out of extended warranty. I call ford company and the said my TCM is still under warranty until the end of this year 2022. Today I am taking it back to another ford dealer if the do not fix my car without having to pay I will definitely would like to file a law suit if they refuse to fix my car with out paying.

I bought my son a 2015 Ford Focus it has been in the shop numerous times for shuttering almost stopping on the interstate. Going 10 speed. Now it won’t go in reverse. He had numerous parts repaired on the transmission and still doing the same thing now they are saying it needs a whole new transmission. An underivable vehicle unsafe it put his life in danger. Now they wont cover defective transmission. It jerked so hard with shuttering he almost lost control and if it wasn’t for the fast action of motorist behind him squealing brakes and swerving he would have been in a crash.

How do I join the class actions. I purchase a ford focus in 2015 bran new ,on my first schedule maintenance I told the technician that transmission was jerking, he told me their was no problem his words was ” it’s a new car” .I complain a second time something no problems. I’m in the same boat.. I purchased a 2012 Focus with 52K miles from my grandmother in November 2021, she purchased car new and only drove it short trips around town which didn’t allow enough time for trans to overheat and cause issues. However I drive much more.. (66k miles now) my first experience with the transmission jumping gears was 4 days after I got it.. discovered Fords Extended warranty program, but was denied repair and charged $165 for “diagnostics and reprogramming” The rest of the winter months (NE Ohio) I had no more issues. As Summer approached I started experiencing more and more “oh Sh!t” moments when transmission overheats and shuts down forcing me to pull to side of road or in someone’s driveway and “wait 10 min” for the trans to cool (dashboard warning system) or on the freeway and randomly and unexpectedly the trans jumps to a lower gear Lurches me and any passengers/cargo forward then refuses to accelerate which often forces me to drive into median to avoid collision. Just the other day I went to leave work after the car was sitting all day and it would not go in reverse, it would go forward but no reverse. And the day before that I ran to grocery store and when I went to leave the car wouldn’t go forward or backwards. My dog and I had to sit there for at least 20 min in 90° temperature waiting for the trans to cool. Everyday there is something new happening and I am seriously starting to get scared driving that car around.

I have 2017 ford fiesta. There is continuous clutch shudder (cracking noise) and harsh shifting. How to participate in this lawsuit?

Purchased New Focus 9/18/18 ADJUSTED RVC on 10/02/20 mileage 16,724 didn’t solve problem 2 weeks later ordered clutch assembly mileage 17,068 did not arrive till 2/24/21 called about same problem 3/15/22 vehicle became worst , on 6/17/22 failed test ORDERED 2nd Cluch assembly keep calling over a month still on Back Order ,problem worst ! My son had a 2017 cord focus SEL. It has the dual clutch and he has had nothing but problems. It leaves him stuck in oncoming traffic because it jumps and stops. He can’t even go up any kind of hill. He has tried to get out of ownership and we can not find any way out of this death trap. We have all the proof needed and it’s been fixed more than once and now completely gone again.

2012 Ford Focus – Transmission issues because of the defect. We were not made aware of the recalls/class action lawsuit. Transmission has been replaced and still continues to have numerous issues. The vehicle has had only 1 owner and has 100,000-110,000 and not able to drive it at all. Are we still able to enter this lawsuit? Ford had a defective transmission control module in my 2014 Ford Focus SE. The orders for replacement are said to be 94K plus. There is no telling when the back order will be available, many months or years.

If I am waiting more than six months with no vehicle, is this bad faith for not providing the TCM in a timely fashion? Is there a class action suit against ford for failure to provide TCMs?
